ASCLEPIUS (Advanced Smart Clinical Ledger for Efficient Practice, Intelligent Unified System) is a proprietary clinical management platform designed exclusively for registered healthcare professionals. All intellectual property in ASCLEPIUS — including but not limited to software, algorithms, clinical workflows, AI integration methods, user interface designs, databases, and content — is the exclusive property of ASCLEPIUS and its owners.
© 2026 ASCLEPIUS. All rights reserved. Unauthorised copying, reproduction, distribution, reverse engineering, or commercial exploitation of any part of this system is strictly prohibited and may result in civil and criminal liability.
2. Eligibility & Access
- ASCLEPIUS is available exclusively to registered, licensed healthcare practitioners and their authorised staff.
- You warrant that you hold a valid registration with the relevant regulatory body (e.g. HPCSA, GMC, AHPRA, or equivalent) for your country of practice.
- Access credentials are personal and non-transferable. You are responsible for all activity under your account.
- ASCLEPIUS reserves the right to suspend or terminate access at any time for breach of these terms.
3. AI-Assisted Features — Limitations of Liability
ASCLEPIUS incorporates artificial intelligence features (Claude, Gemini) as clinical decision support tools only. By using these features, you acknowledge and agree that:
- AI outputs are suggestions only and must be independently verified before any clinical application.
- The treating practitioner retains full clinical and legal accountability for all patient care decisions.
- AI does not replace a clinical examination, professional judgement, or the practitioner-patient relationship.
- ASCLEPIUS and its owners accept no liability for any clinical outcome, adverse event, misdiagnosis, or harm arising from reliance on AI-generated content.
- These features comply with HPCSA Booklet 20 (Ethical Guidelines on the Use of AI, September 2025).
4. Prohibited Uses
You must not use ASCLEPIUS to:
- Provide medical advice directly to patients without a valid practitioner-patient relationship.
- Process patient data without valid legal authority or patient consent where required.
- Reverse engineer, decompile, scrape, copy, or reproduce any part of the platform.
- Share login credentials or grant unauthorised access to third parties.
- Use the platform for any unlawful purpose, including fraudulent billing claims.
- Attempt to circumvent security measures or access data belonging to other practitioners.
5. Intellectual Property
All content, code, designs, clinical workflows, AI integration methods, terminology databases, billing engines, and other materials within ASCLEPIUS are protected by:
- Copyright — automatically vested in the creators under the Copyright Act 98 of 1978 (South Africa) and equivalent international law.
- Trade secrets — proprietary algorithms, workflows, and clinical logic constitute confidential trade secrets.
- Database rights — the structured medical terminology database, ICD-10 mappings, and billing code systems are proprietary compilations.
No licence, right, or interest in ASCLEPIUS intellectual property is granted to users beyond the limited right to use the platform for its intended clinical purpose.
6. Patient Data & POPIA Compliance
- The practitioner is the primary responsible party for patient personal information entered into the platform.
- ASCLEPIUS acts as an operator and processes patient data strictly on the practitioner's instruction.
- Both parties agree to comply with POPIA and applicable international data protection laws.
- The practitioner warrants they have obtained all necessary patient consents before entering data into the platform.
7. Disclaimer of Warranties
ASCLEPIUS is provided "as is" and "as available". To the maximum extent permitted by law, ASCLEPIUS:
- Does not warrant uninterrupted or error-free access.
- Does not warrant that clinical content is complete, current, or error-free.
- Accepts no liability for decisions made based on platform outputs.
- Accepts no liability for data loss, system downtime, or third-party service failures.
8. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to ASCLEPIUS's right to seek urgent relief in any competent jurisdiction.
9. Amendments
ASCLEPIUS reserves the right to amend these Terms at any time. The updated Terms will be posted with a revised effective date. Continued use after changes constitutes acceptance.
